Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "the user", "the subscriber") and Abdlarhman Omar Ahmad Shaheen, an individual trader established in Jordan, operating the website AquaQBank at aquaqbank.com ("AquaQBank", "we", "us", "our"). By creating an account, ticking the acceptance box at sign-up, purchasing access, or otherwise using AquaQBank, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which form part of this agreement. If you do not agree, do not create an account and do not purchase access.

1. WHO WE ARE

1.1 Seller and operator: Abdlarhman Omar Ahmad Shaheen, Jordan.

1.3 We are an independent educational service. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of any university, faculty, examination board or medical licensing authority.

2. WHAT WE SELL

2.1 AquaQBank sells access to digital educational content only. There are no physical goods, no shipping and no printed materials.

2.2 The content consists of a question bank of university archive examination questions, each provided with a model answer and a written explanation, together with related study material such as summaries, lecture-linked question sets, quizzes, progress tracking and study-plan tools.

2.3 "University archive questions" means questions collected from previously sat university examinations and course assessments, reproduced, corrected, re-typed, restructured and explained by our team. Questions are edited and the accompanying solutions and explanations are original work authored by AquaQBank.

2.4 Content is delivered online only, through your AquaQBank account, and is intended for study and revision.

2.5 We continuously add, correct, reorganise and remove content. The exact number of questions, subjects or features available at any moment may change during your access period.

3. ELIGIBILITY AND ACCOUNTS

3.1 You must be at least 16 years old, or the age of digital consent in your country if higher, to create an account. If you are under 18, you confirm that a parent or legal guardian consents to your use of the service and to any purchase.

3.2 You must provide accurate, current and complete registration information, including a valid email address that you control.

3.3 An account is personal and belongs to one individual. You may not share, sell, lend, rent, sublicense, transfer or make your account available to any other person.

3.4 You are responsible for keeping your password confidential and for all activity that occurs under your account. Tell us immediately at aquaqbank@gmail.com if you suspect unauthorised use.

3.5 We may apply a device limit and device-verification measures to each account. Repeated sign-ins from an unusual number of devices may trigger an automatic lock until you contact support.

4. EMAIL VERIFICATION

4.1 After signing up you must verify your email address using the link we send you. Until your email is verified, sign-in and access to purchased content may be refused.

4.2 We use your email address for verification, password resets, security notices, purchase confirmations and essential service messages. These are transactional and cannot be opted out of while your account is open.

5. PRICES, BILLING AND PAYMENT

5.1 Access to paid content is sold either for a full academic year or for a single semester, depending on the specific course or package. The exact duration, price and currency of each offer are shown on the product or checkout page before you pay. The price shown at checkout is the price you pay.

5.2 Prices may be displayed exclusive or inclusive of applicable sales tax or VAT depending on your location; the final amount, including any tax, is always shown before you confirm the purchase.

5.3 Payment is taken in full and in advance for the whole access period. We do not offer instalments unless expressly stated on the checkout page.

5.4 Access periods do not renew automatically unless the checkout page for that specific product clearly states that it is a recurring subscription. Where a product is recurring, the renewal price, interval and cancellation method are stated at checkout, we send a reminder before each renewal where required by law, and you can cancel at any time before the renewal date to avoid the next charge.

5.5 When an access period ends, paid content becomes unavailable. Your account, profile and free content remain accessible unless you ask us to delete the account.

5.6 We may change our prices at any time. Price changes never affect an access period you have already paid for.

5.7 Coupon codes, discounts and group or package prices are subject to any additional conditions shown with the offer, may be withdrawn at any time, and cannot be applied retroactively to a completed purchase.

6. PAYMENT PROCESSING AND MERCHANT OF RECORD

6.1 Our order process is conducted by our online reseller and payment provider, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries relating to billing and handles returns of payments.

6.2 This means Paddle, and not AquaQBank, is the seller of record for the transaction, is responsible for collecting and remitting any applicable sales tax or VAT, and will appear on your card or bank statement in connection with the purchase.

6.3 By completing a purchase you also agree to Paddle's buyer terms and privacy notice, published at paddle.com. Where those terms give you a right in respect of the payment itself, they apply in addition to these Terms.

6.4 We do not receive or store your full card number, CVV or bank credentials. Payment details are handled entirely by Paddle.

6.5 Billing enquiries may be raised with Paddle directly or with us at aquaqbank@gmail.com; we will help you resolve them.

7. DELIVERY AND ACCESS

7.1 Delivery is electronic and immediate. As soon as your payment is confirmed, the purchased content is unlocked inside your AquaQBank account, and you receive a confirmation email.

7.2 Because delivery is immediate, you expressly request and consent to the supply of the digital content beginning at once, and you acknowledge the effect this has on cancellation rights as described in clause 8 and in our Refund Policy.

7.3 You are responsible for your own internet connection and device. Access requires a modern browser and an active connection.

7.4 We aim for continuous availability but do not guarantee uninterrupted service. Planned maintenance, updates and occasional outages may occur.

8. REFUNDS AND CANCELLATION

8.1 The content we sell is digital and is delivered immediately, so it cannot be returned.

8.2 By purchasing and accessing the content you agree that the supply begins immediately and, to the fullest extent permitted by applicable law, you waive any statutory cooling-off or withdrawal right that would otherwise apply to distance-sold digital content.

8.3 Accordingly, purchases are non-refundable once the purchased content has been accessed, opened or used in any way.

8.4 We will nevertheless issue a full refund where: (a) you were charged more than once for the same purchase; (b) the purchase was made fraudulently on your payment method and this is confirmed; (c) the content you paid for was never delivered to your account and we are unable to deliver it; or (d) a substantial technical fault prevents you from using the content and we are unable to fix it within a reasonable time.

8.5 Refund requests under clause 8.4 must be sent to aquaqbank@gmail.com with your order reference. Approved refunds are processed by Paddle to the original payment method, normally within 5–10 business days.

8.6 Nothing in this clause limits rights that cannot be excluded under the mandatory consumer law of your country of residence.

8.7 You may stop using the service and close your account at any time; closing an account during a paid access period does not create a right to a refund of the unused part, except as set out above.

9. LICENCE AND ACCEPTABLE USE

9.1 Subject to payment and to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the purchased content for your own private study during your access period.

9.2 You must not, and must not allow anyone else to: copy, reproduce, download in bulk, scrape, crawl, mirror, republish, post, distribute, sell, resell, licence, broadcast, or otherwise make the content available to any third party; take, share or publish screenshots, screen recordings, photographs or transcriptions of the content; upload the content to any file-sharing service, messaging group, cloud drive, social network or other question bank; use the content to build, train or fine-tune any dataset, model or competing product; remove or obscure any watermark, attribution or protective measure; or attempt to circumvent, disable or interfere with any security, device-limit or access-control feature.

9.3 You must not use the service to break any law, to cheat in any examination in breach of your institution's rules, to harass any person, to transmit malware, or to gain unauthorised access to our systems or another user's account.

9.4 We use technical protection measures, including watermarking that may display identifying information tied to your account, device registration and activity logging, in order to detect and deter unauthorised copying. You consent to these measures.

9.5 Breach of this clause is a material breach. We may suspend or terminate your access immediately, without refund, and we may pursue any remedy available to us in law.

10. INTELLECTUAL PROPERTY

10.1 The AquaQBank platform, its design, brand, logos, structure, database, question selection and arrangement, model answers, explanations, summaries and all other materials are owned by Abdlarhman Omar Ahmad Shaheen or licensed to us, and are protected by copyright, database and trade mark law.

10.2 Nothing in these Terms transfers any ownership to you. Only the limited licence in clause 9.1 is granted.

10.3 Where any underlying examination question is the work of a third party, it is reproduced, corrected and re-expressed for educational commentary, criticism and teaching purposes. If you are a rights holder and believe material has been used improperly, contact aquaqbank@gmail.com and we will review and, where appropriate, remove it promptly.

10.4 Any feedback, error report or suggestion you send us may be used by us without restriction and without obligation to you.

11. USER-SUBMITTED CONTENT

11.1 If you post notes, flags, comments, support messages or other material, you keep ownership of it and grant us a worldwide, royalty-free licence to store, display and use it for the purpose of operating and improving the service.

11.2 You must not submit anything unlawful, defamatory, infringing, offensive, or containing another person's private data.

11.3 We may remove any user-submitted content at our discretion.

12. ACADEMIC AND MEDICAL DISCLAIMER

12.1 AquaQBank is a revision aid. It is not a substitute for your official curriculum, lectures, textbooks or clinical training.

12.2 We do not guarantee that any question will appear in any examination, nor that using our service will lead to any particular grade, pass or outcome.

12.3 Content may contain errors and medical knowledge changes over time. Nothing on AquaQBank is medical advice and it must never be used to diagnose or treat any person. Always rely on current authoritative sources and qualified supervision in clinical practice.

13. SUSPENSION, BLOCKING AND TERMINATION

13.1 We may suspend, temporarily block or permanently terminate an account where we reasonably believe there has been a breach of these Terms, account sharing, content piracy, fraudulent payment, abuse of staff, or a risk to the security of the platform.

13.2 Where an account is blocked or temporarily stopped, we will show you the reason and, for temporary measures, the duration when you attempt to sign in.

13.3 Termination for breach does not entitle you to any refund.

13.4 You may close your account at any time by contacting aquaqbank@gmail.com. We will delete or anonymise your personal data as described in the Privacy Policy, keeping only what the law requires us to retain.

14. SERVICE CHANGES AND AVAILABILITY

14.1 We may add, modify, suspend or discontinue any feature or part of the service. Where a change would substantially remove the core benefit of content you have already paid for, we will provide either a reasonable equivalent or a pro-rata refund for the unused period.

14.2 We may set fair-use limits on features that consume significant resources, including any AI-assisted tools.

15. WARRANTIES AND LIABILITY

15.1 The service is provided "as is" and "as available". To the fullest extent permitted by law we exclude all implied warranties, including fitness for a particular purpose, accuracy and non-infringement.

15.2 We are not liable for indirect, incidental, special, consequential or punitive losses, for loss of profits, opportunity, data, or for examination results, academic outcomes or career consequences.

15.3 Our total aggregate liability to you for any claim arising out of or in connection with the service is limited to the total amount you actually paid to us or to Paddle for the service in the twelve (12) months preceding the event giving rise to the claim.

15.4 Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or for any liability that cannot lawfully be excluded.

16. INDEMNITY

You agree to indemnify and hold harmless Abdlarhman Omar Ahmad Shaheen against any claim, loss, damage, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, or your unlawful distribution of the content.

17. PRIVACY AND DATA

Your personal data is processed as described in our Privacy Policy. Payment data is processed by Paddle under its own privacy notice.

18. CHANGES TO THESE TERMS

18.1 We may update these Terms to reflect changes in the service, in our payment arrangements or in the law. The "last updated" date at the top will change.

18.2 Material changes will be notified by email or by a clear notice on the site before they take effect. Continuing to use the service after that date means you accept the updated Terms. If you do not accept them, stop using the service and contact us.

19. GOVERNING LAW AND DISPUTES

19.1 These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-law rules, and the competent courts of Amman, Jordan have jurisdiction.

19.2 If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of your country of residence where the law gives you that right.

19.3 Before starting any formal proceedings, please contact us at aquaqbank@gmail.com so that we can try to resolve the matter directly. Billing disputes should also be raised with Paddle as Merchant of Record.

20. GENERAL

20.1 These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between us regarding the service.

20.2 If any provision is found unenforceable, the rest remains in force.

20.3 Our failure to enforce a provision is not a waiver of it.

20.4 You may not assign your rights under these Terms. We may assign ours to a successor of the business, provided your rights are not reduced.

20.5 We are not liable for failure caused by events beyond our reasonable control.
